ST. LOUIS — Energizer Brands has filed suit against Spectrum Brands, alleging that its Rayovac batteries are packaged with a design too similar to Energizer’s own. The suit alleges that Rayovac is trying to “boost the sales of its batteries by cloaking them in trade dress and packaging that is confusingly similar to the well-known trade dress and packaging of its successful rival, Energizer.” According to the St. Louis Post-Dispatch, neither company’s reps would comment on the suit. Energizer previously sued Duracell in February, claiming it was selling batteries in the U.S. with a pink bunny mascot similar to the famous Energizer Bunny.
